Welcome to Soulful Harp. These Terms & Conditions explain the terms that apply when you use soulfulharp.co.uk, book my harp services, arrange a wedding or event performance, take harp lessons, or purchase digital recordings from me.
By making a booking or purchase, you agree to these Terms & Conditions.
Nothing in these Terms & Conditions affects your statutory rights under applicable consumer law.
1. About Soulful Harp

In these Terms & Conditions, “I”, “me” and “my” refer to Emma Yates/Soulful Harp.
“You” and “your” refer to the person making a booking or purchase.
2. Services
Soulful Harp provides services including:

Harp performances
-
Wedding harp performances
-
Performances for private and public events
-
Harp lessons
-
Digital recordings and other digital products
The exact service, date, time, location, price and any specific arrangements will be confirmed with you when you make your booking.
3. Making a Booking
A booking is confirmed once:

We have agreed the details of the service;

You have received confirmation from me; and
-
Any required deposit or payment has been received.
For wedding bookings, a £100 deposit is required to secure your date.
Your booking is not considered confirmed until the required deposit has been received, unless I have agreed otherwise with you in writing.
Once your booking is confirmed, I will reserve the agreed date and time specifically for you.
4. Prices and Payment
Prices will be communicated to you before you confirm your booking or purchase.
Payment may be made using the payment methods I make available, which may include:

PayPal
-
BACS/bank transfer

Other payment methods made available at the time of booking or purchase
For wedding bookings, the remaining balance must be paid by the date specified in your booking confirmation or invoice.
If payment is not received by the agreed date, I may contact you to arrange payment. If payment remains outstanding, I may need to treat the booking as cancelled, subject to applicable law and the circumstances of the booking.
5. Wedding Bookings
Wedding bookings are reserved specifically for the date and time agreed with you.
A £100 deposit is required to secure your wedding date.
The deposit is non-refundable if you subsequently cancel your wedding booking, subject to your statutory rights.
The remaining balance is refundable if you cancel your wedding booking at least 3 months (90 days) before the wedding date.
If you cancel less than 3 months (90 days) before the wedding date, the remaining balance will normally be non-refundable.

6. Changes to Your Booking
If you need to change any part of your booking, such as the date, time, venue or duration, please contact me as soon as possible.
I will do my best to accommodate reasonable changes, but I cannot guarantee that I will be available for a different date or time.
A change to the date may be treated as a cancellation of the original booking and a new booking if I am unable to accommodate the requested change.
Any additional costs resulting from a change to the booking will be discussed with you before the change is confirmed.
7. Venue and Event Requirements
For performances, you are responsible for providing accurate information about the venue and event, including:

The correct venue address;

The agreed performance location;

Suitable access to the performance area;

Any relevant parking or access arrangements;
-
Any venue restrictions or requirements that I need to know about in advance;

Sufficient space and suitable conditions for the harp and performance.
If there are stairs, restricted access, long distances between parking and the performance area, unusual access arrangements or other circumstances that could affect the performance, please let me know in advance.
You are responsible for obtaining any permissions required by the venue for my performance.
8. Performance Times
I will make reasonable efforts to arrive in sufficient time to prepare for your performance.
The agreed performance time will be based on the information provided when the booking is made.
If an event runs late or the performance is delayed because of circumstances outside my reasonable control, I will do my best to accommodate the change where possible.
If a significant delay affects the amount of performance time available, I will discuss the situation with you and seek a reasonable solution.
9. Music Requests
Where appropriate, you may request particular pieces of music in advance.
I will do my best to accommodate reasonable music requests, subject to the availability of suitable arrangements and my ability to perform the requested piece.
Requests for particular music should be made as early as possible, particularly for weddings.
I cannot guarantee that every requested piece will be available or suitable for harp.
10. Weddings and Event Coordination
For weddings and events, you are responsible for providing accurate timings and details and informing me promptly of any changes.
If another supplier, venue or organiser is responsible for the event schedule, I may need to rely on the information provided to me.
I will make reasonable efforts to coordinate with you and relevant event professionals where necessary.
11. If I Am Unable to Perform
I will make every reasonable effort to provide the service that you have booked.
If I become unable to perform due to illness, injury, an emergency or another serious circumstance, I will contact you as soon as reasonably possible.
Where appropriate, I may arrange a suitable replacement harpist or performer.
If a suitable replacement cannot be arranged and I am unable to provide the agreed service, I will provide an appropriate refund for the service I am unable to provide, subject to your statutory rights.
12. Events Outside My Reasonable Control
I will not be responsible for failure or delay caused by circumstances outside my reasonable control.
These may include, for example:

Severe weather;

Natural disasters;
-
Fire or flooding;
-
Serious illness or injury;
-
Road closures or major transport disruption;
-
Government restrictions;
-
Venue closure;
-
Civil emergencies;
-
Acts of terrorism;
-
Power failures;
-
Other circumstances that could not reasonably have been anticipated or prevented.
If such circumstances affect your booking, I will communicate with you as soon as reasonably possible and work with you to find a reasonable solution.
This does not remove any rights you may have under applicable consumer law.
13. Harp Lessons
Lesson arrangements, including the date, time, duration and price, will be confirmed when the lesson is booked.
Please give as much notice as possible if you need to cancel or rearrange a lesson.
Lessons cancelled at short notice or missed without notice may be non-refundable because the time has been specifically reserved for you.
Where reasonable notice is provided, I may offer an alternative lesson date or another appropriate arrangement.
If I need to cancel a lesson, I will offer an alternative date or an appropriate refund.
14. Digital Recordings
Digital recordings purchased through the Website are supplied electronically.
You are responsible for providing a valid email address and ensuring that you have a suitable device and internet connection to access or download the recording.
Digital recordings are for your personal use unless otherwise stated.
You must not reproduce, distribute, resell, publicly share, upload, or commercially exploit recordings without my written permission.
Nothing in these Terms & Conditions affects your statutory rights relating to digital content.
Where digital content is supplied immediately, I will comply with applicable requirements concerning your cancellation rights and obtaining any required acknowledgement or consent before access or download begins. (GOV.UK)
15. Refunds and Cancellations
Refunds and cancellations are dealt with in more detail in my Refund & Cancellation Policy.
That policy forms part of these Terms & Conditions.
If there is any conflict between these Terms & Conditions and the Refund & Cancellation Policy, the specific terms communicated to you for your particular booking or purchase will apply, subject to your statutory rights.
16. Intellectual Property
Unless otherwise stated, the content of the Soulful Harp Website and materials I provide, including recordings, photographs, written content, arrangements, branding, logos and other original materials, belongs to me or is used with appropriate permission.
You may not copy, reproduce, modify, distribute or commercially exploit my original content without my prior written permission.
Where you purchase a digital recording, you are purchasing access to the digital product for your personal use, not ownership of the underlying copyright.
17. Photography, Video and Recording
If you wish to photograph, film or record my performance, please let me know where appropriate.
You must not use recordings of my performance commercially or in a way that falsely suggests my endorsement without my permission.
I may sometimes take photographs, video or audio recordings of performances for promotional purposes. I will seek appropriate permission where required before using identifiable images or recordings of you for marketing.
18. Website Content
I make reasonable efforts to ensure that information on the Website is accurate and up to date.
However, I cannot guarantee that the Website will always be completely free from errors, omissions or technical problems.
I reserve the right to update, change or remove Website content where reasonably necessary.
19. Third-Party Websites and Services
The Website may contain links, embedded content or services provided by third parties, including payment providers, social media platforms, video platforms and booking services.
I am not responsible for the content, availability, security or privacy practices of third-party websites or services.
Your use of third-party services may be subject to their own terms and conditions.
20. Liability
I will provide my services with reasonable care and skill and in accordance with applicable consumer law.
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
Subject to the above, I will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside my reasonable control.
21. Your Responsibilities
You agree to provide accurate information when making a booking or purchase.
You are responsible for informing me promptly of any changes that could affect the service I am providing.
For events and weddings, you are responsible for ensuring that the venue and event arrangements allow me to provide the agreed service safely and effectively.
22. Privacy
Your personal information will be handled in accordance with my Privacy Policy, which explains what information I collect, why I collect it and how I use and protect it.

I hope you will be happy with the service I provide.

I will consider your complaint fairly and aim to resolve any issue reasonably.
24. Governing Law
These Terms & Conditions are governed by the law of England and Wales, unless applicable consumer protection law in your country gives you additional mandatory rights that cannot legally be excluded.
Any dispute will be dealt with by the courts having appropriate jurisdiction, subject to any mandatory consumer rights that apply to you.
25. Changes to These Terms & Conditions
I may update these Terms & Conditions from time to time.
The version that applies to your booking or purchase will normally be the version that was in place when you entered into the relevant agreement, unless a change is required by law or agreed with you.
The latest version will be published on the Website with the date it was last updated.
